Most cases settle at the negotiation stage, but should the matter proceed to the tribunal, our team have successfully represented clients in Lower and Upper Tribunals. Lease extension can be through informal or statutory route. Under the informal route, a leaseholder may approach their freeholder for an offer to extend the lease. The new lease terms and premium are entirely subject to negotiation with the freeholder, revision of ground rent and at an open pace. However, to avoid these uncertainties, a leaseholder can proceed under a formal route, protected by the Leasehold Reform Housing and Urban Development Act 1993, with specific provisions for a 90-year extension at zero (peppercorn) ground rent from the date of extension. To initiate the formal route, a leaseholder would require a valuation providing potential range of premiums and serve a Section 42 Notice on the Landlord.
